These Terms & Conditions apply to the use of the Baudry Studio website and to purchases of products and services offered by Baudry Studio.

By placing an order or entering into an agreement with Baudry Studio, you agree to these Terms & Conditions.

2. Products and services

Baudry Studio offers creative products as well as freelance marketing, design, textile and fashion-related services.

Products available through the webshop may include original artworks, textile artworks, prints and other creative products.

Professional services may include marketing and creative services, surface pattern and textile print design, fashion product development, sampling and production support, and related creative services.

The exact scope, timing, price and deliverables of freelance or custom services may be agreed separately in writing between Baudry Studio and the client.

3. Product information

Baudry Studio makes every reasonable effort to display product descriptions, photographs, colours, dimensions and other information as accurately as possible.

Due to differences in screens, materials and handmade production processes, colours and finishes may vary slightly from what is displayed online.

For handmade products, small variations and irregularities may occur. These are part of the unique character of handmade work and are not necessarily considered defects.

4. Prices

All prices displayed on the website are in euros (€), unless otherwise stated.

Prices include VAT where applicable, unless explicitly indicated otherwise.

Shipping costs, where applicable, are displayed separately during checkout.

Baudry Studio reserves the right to change prices at any time. The price applicable to an order is the price displayed and confirmed at the time the order is placed.

For custom projects and freelance services, prices may be provided through a separate quotation or agreement.

5. Orders

An order is considered accepted once the customer receives an order confirmation.

Baudry Studio reserves the right to refuse or cancel an order in the event of an obvious pricing error, product unavailability, suspected fraud or another legitimate reason.

If an order that has already been paid cannot be fulfilled, the customer will be informed and the relevant amount will be refunded.

6. Payment

Payment for webshop purchases must be made using one of the payment methods available at checkout.

Orders will only be processed once payment has been successfully received or authorised.

For freelance services, custom work or commissioned projects, separate payment terms may apply and will be communicated in the relevant quotation, proposal or agreement.

Baudry Studio may request an advance payment or deposit before starting custom or freelance work.

7. Shipping

Orders are carefully packed and shipped from Belgium.

Available shipping methods and shipping costs are calculated at checkout based on the delivery address, order and selected shipping method.

Once an order has been shipped, the customer will receive shipping confirmation and tracking information where available.

Estimated delivery times are indicative and may vary depending on the destination and shipping carrier.

Baudry Studio cannot be held responsible for delays caused by shipping carriers, customs procedures or circumstances beyond its reasonable control.

Customers are responsible for providing a complete and correct delivery address.

8. International orders

For orders shipped outside the European Union, customers may be responsible for customs duties, import taxes or other charges imposed by the destination country.

These costs are not included in the product price or shipping costs unless explicitly stated otherwise.

Baudry Studio cannot be held responsible for delays caused by customs procedures.

9. Handmade and made-to-order products

Certain products may be handmade or made to order.

Where applicable, estimated production times will be mentioned on the relevant product page or communicated to the customer.

Production and delivery estimates are indicative and may vary depending on the nature of the product.

10. Right of withdrawal and returns

Consumers purchasing products online generally have the right to withdraw from their purchase within 14 days of receiving the goods, in accordance with applicable Belgian and European consumer law.

To exercise your right of withdrawal, please contact Baudry Studio at hello@baudrystudio.com within the applicable withdrawal period and clearly state that you wish to withdraw from the purchase.

After notifying Baudry Studio of the withdrawal, the product must be returned within the legally applicable period.

Returned products must be handled with reasonable care and returned in their original condition where reasonably possible.

Unless otherwise required by applicable law, the direct cost of returning the goods is borne by the customer.

Customers are responsible for properly packaging returned products. A trackable shipping method is recommended.

Refunds will be processed in accordance with applicable consumer law.

11. Exceptions to the right of withdrawal

The statutory right of withdrawal may not apply to products that are made to the consumer's specifications or are clearly personalised, where the legal conditions for this exception are met.

This may include certain custom-made, personalised or commissioned products specifically created according to the customer's individual instructions.

This exception does not affect the customer's statutory rights if a product is defective or does not conform to the agreement.

12. Damaged, defective or incorrect products

If a product arrives damaged, defective or incorrect, please contact Baudry Studio as soon as possible at hello@baudrystudio.com.

Please include your order number and, where relevant, photographs showing the issue.

Baudry Studio will assess the situation and provide an appropriate solution in accordance with applicable consumer law.

13. Legal guarantee

Consumers benefit from the statutory legal guarantee applicable under Belgian law.

For new consumer goods, the legal guarantee generally applies for two years from delivery, in accordance with applicable legislation.

Nothing in these Terms & Conditions limits or excludes mandatory statutory consumer rights.

14. Return address

Please contact Baudry Studio at hello@baudrystudio.com before returning a product.

You will then receive the appropriate return instructions and return address.

15. Freelance and professional services

The specific terms applicable to freelance, creative, marketing, textile or fashion services may be set out in a separate quotation, proposal or written agreement.

Such terms may include the agreed scope of work, deliverables, deadlines, revisions, fees, payment schedule and other project-specific conditions.

Unless otherwise agreed in writing, additional work requested by the client outside the agreed scope may be invoiced separately.

Any estimated timeline depends on timely feedback, information and materials being provided by the client.

16. Cancellation of professional services

Cancellation conditions for freelance services, custom projects or commissioned work may be specified in the relevant quotation or agreement.

Work already completed before cancellation may be invoiced.

Any applicable conditions regarding deposits or advance payments will be communicated before the start of the project and will apply in accordance with applicable law.

17. Intellectual property

Unless otherwise agreed in writing, all content created by or displayed by Baudry Studio, including designs, illustrations, surface patterns, artwork, photographs, graphics and other creative content, remains the intellectual property of Baudry Studio or its respective rights holder.

Such content may not be copied, reproduced, modified, distributed, sold or used commercially without prior written permission.

Purchasing a physical product does not transfer copyright or intellectual property rights to the purchaser.

For custom design and freelance projects, intellectual property ownership and usage rights will be determined in the relevant quotation, licence or project agreement.

Where applicable, Baudry Studio may grant specific usage or licensing rights while retaining the underlying intellectual property rights.

18. Confidentiality and portfolio use

Baudry Studio respects confidential information shared by clients in connection with professional services.

Where confidentiality obligations have been agreed in writing, Baudry Studio will comply with those obligations.

Baudry Studio will not publicly display confidential client work without the client's permission where such work is subject to confidentiality restrictions.

For non-confidential projects, portfolio usage may be agreed between Baudry Studio and the client.

19. Liability

Baudry Studio is responsible in accordance with applicable mandatory law.

To the extent permitted by law, Baudry Studio cannot be held responsible for indirect or consequential losses arising from the use of the website, products or professional services.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

20. Privacy

Personal data collected through the Baudry Studio website, webshop and professional services is processed in accordance with applicable data protection legislation.

21. Complaints

If you have a complaint regarding an order, product or service, please contact Baudry Studio at hello@baudrystudio.com so that an appropriate solution can be sought.

Nothing in these Terms & Conditions affects a consumer's right to use legally available dispute resolution procedures or to bring a claim before a competent court.

22. Applicable law

These Terms & Conditions are governed by Belgian law, without prejudice to mandatory consumer protection rights that may apply.

Any disputes will be handled by the competent courts in accordance with applicable law.

23. Changes to these terms & conditions

Baudry Studio reserves the right to update these Terms & Conditions when necessary, for example following changes to its business activities, website or applicable legislation.

The version applicable to a purchase or agreement is the version in effect at the time the relevant order or agreement was concluded, unless otherwise required by law.
